Cerebral palsy (CP) is a group of permanent movement disorders that appear in early childhood. In some cases, CP results from factors that could potentially have been managed or avoided during pregnancy, delivery, or shortly after birth.
Identifying signs that cerebral palsy may have been avoidable involves looking at the circumstances surrounding the prenatal period, delivery, and postnatal care.
Here are some indicators that cerebral palsy might have been preventable:
Inadequate Monitoring of Fetal Distress
If there were signs of fetal distress during labor and delivery that were not adequately monitored or addressed, this could have led to oxygen deprivation and resulted in CP.
Delay in Performing a Necessary C-Section
Timely decision-making regarding the need for a cesarean section is critical. A delay in performing a C-section when needed (for reasons like prolonged labor or fetal distress) could contribute to the baby developing CP.
Failure to Treat Maternal Infections
Some maternal infections can increase the risk of cerebral palsy in the baby. Failure to diagnose or treat these infections appropriately during pregnancy can be a contributing factor.
Improper Use of Delivery Instruments
The incorrect use of delivery instruments such as forceps or vacuum extractors can lead to head trauma or brain injuries, increasing the risk of CP.
Neglecting to Address Jaundice
Newborn jaundice, if severe and left untreated, can lead to a condition called kernicterus, which can cause cerebral palsy. Proper monitoring and treatment of jaundice are crucial.
Poor Handling of Breathing Problems
If a newborn experiences breathing difficulties and these are not managed correctly and promptly, the resulting lack of oxygen could potentially lead to brain damage and CP.
Lack of Proper Care for Low Birth Weight or Premature Babies
Premature infants and those with low birth weight are at a higher risk of developing CP. They require specialized care, and the absence of such care might increase the likelihood of CP.
It's important to understand that not all cases of cerebral palsy are preventable, and the presence of one or more of these factors does not automatically imply negligence or that CP was definitely avoidable.
However, these signs can warrant further investigation into the care provided during pregnancy, delivery, and the postnatal period. If you suspect medical malpractice played a role in your child developing cerebral palsy, consulting with a legal professional who specializes in medical malpractice might provide clarity and potentially a path forward.
Your child may potentially qualify for lifetime benefits and assistance, including:

Assistive Technology
